may be contained thereunder, and supersedes any other written or oral agreement.

The Advertiser warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to Pickavilla the rights therein contained. The Advertiser indemnifies Pickavilla against any action brought for breach of copyright from the use of such material supplied by the Advertiser. 4. Pickavilla claims copyright to the electronic images produced from the photographic material supplied by Advertisers. Trademark 5. "Pickavilla" is the trademark and service mark of Pickavilla. All other trademarks, service marks and logos used in this Site are the trademarks, service marks or logos of their respective owners. Layout and content on the Pickavilla internet site 6. Pickavilla reserves the right to amend the design layout or edit the content of, and photographs or images supplied for the Site, should they consider it necessary. 7. Pickavilla reserves the right to amend or edit information entered into the Pickavilla online database by Advertisers, or submitted via the Villa Application form, should they consider it necessary . 8. Pickavilla cannot be held responsible for any loss or damage resulting from the design layout of the advertisements or changes made to the photographs, images or information submitted by the Advertiser. Accuracy of information 9. Although Pickavilla attempts to ensure the integrity and accurateness of the Site, Pickavilla cannot accept any legal responsibility for the accuracy of the advertisements or guarantee the standard of the properties in the advertisements published in its internet pages, or any alleged breaches of contract on an advertiser's part. The accuracy of the information on the Site is the sole responsibility of the owner or agent of the property advertised. 10. Every effort will be made to reproduce faithfully all advertisements submitted, but Pickavilla cannot be held responsible for any typographical errors in the information supplied or any loss or damage or otherwise resulting from errors or omission. 11. It is possible that the Site could include inaccuracies or errors, and that unauthorized additions, deletions and alterations could be made to the Site by third parties. In the event that an inaccuracy arises, please inform Pickavilla by sending an email to info@pickavilla.com so that it can be corrected. Substitution of properties 13. An advertisement relates to a specific property. The property in an advertisement may not be substituted by another property. 14. Advertisers can request the removal of an advertisement from the Site at any time by contacting Pickavilla. No refunds will be paid if this occurs before the end of the subscription period. 15. Pickavilla reserves the right to refuse any advertisement for the Site, and will not be liable for any expense in so doing. 16. Pickavilla reserves the right to delete or remove an advertisement from the Pickavilla site, without notice and without payment of any refunds, if:
Linked Internet Sites Hypertext links 18. Pickavilla is not responsible for the content available on any other Internet sites linked to the Site. Access to any other Internet sites linked to the Site is at the User’s own risk. 19. Pickavilla reserves the right to refuse hypertext links to, or addresses of, other web sites from advertisers pages, and to remove links or web addresses without notice at our sole discretion. 20. Pickavilla reserves the right to charge for hypertext links at any time. Warranty Disclaimer 21. You assume total responsibility and risk for your use of the Site and the use of any information obtained via Pickavilla. Your sole remedy for dissatisfaction with the Site and/or any Site-related services is to stop using the Site and/or those services. 22. Pickavilla does not warrant that the operation of the Site will be uninterrupted or error-free and does not make any warranty as to the results to be obtained from use of the service. 23. The Advertiser and/or User agrees to indemnify and hold without harm Pickavilla, its officers, employees, agents, directors and other Users from any and all claims, damages, expenses and liabilities resultant from any and all use of the Site whether authorized or not authorized. 24. Pickavilla disclaims all warranties in regard to the information contained within the Site and any literature advertising, promoting or giving information about the service. The Site, including any content or information contained within it or any Site-related service, is provided "as is" with no representations or warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties or merchantability, fitness for a particular purpose, and noninfringement. 25. Pickavilla is neither responsible nor liable for any special, direct, indirect, incidental, consequential, special, exemplary, punitive or any damages whatsoever arising from loss of use, data or profits, whether an action of contract, negligence or other tortious action, arising from or relating in any way to the Site and/or content or information contained within the Site. 26. In no event shall Pickavilla be liable to the Advertiser or User for any special, consequential, incidental or indirect damages, including lost profits, however caused, on any theory of liability, including but not limited to product liability. 27. Pickavilla shall be under no liability in respect of damage or otherwise sustained as result of any contractual arrangements made between the User and Advertiser or owner or their agent. 28. Descriptions of, or references to, anything within the Site, does not imply endorsement of their services or products. 29. Use of this site to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engage in any kind of illegal activity is expressly prohibited. 30.
